Waste Collection Services Agreement
1. Introduction
These Terms & Conditions ("Terms") set out the basis on which EZ Waste Removals Ltd ("EZ Waste Removals", "we", or "us") provides waste removal and disposal services (the "Services") to customers ("you" or the "Customer"). By booking our Services, you agree to these Terms, creating a legally binding contract between you and us. If you do not accept these Terms, please do not make a booking or use our Services. We may update these Terms from time to time by posting the latest version on our website.

3. Who These Terms Apply To
Consumers -

A "Consumer" is an individual booking our Services for personal, non-commercial use.

If you identify as a Consumer, paragraphs 10—12 (cancellation) and 20—22 (liability) apply.
Businesses -

A "Business" is any company, organisation, or sole trader using our Services for commercial purposes.

If you are a Business, paragraphs 13—15 (cancellation) and 23—25 (liability) apply
4. Use of Subcontractors
We may engage licensed waste carriers or contractors ("Suppliers") to perform some or all of the Services. References to "we" or "us" include both EZ Waste Removals and our Suppliers where appropriate. We remain responsible for the quality and legal compliance of the Services provided.
5. Our Responsibilities

We will carry out the Services with reasonable skill and care.

All Suppliers we work with are required to comply with applicable waste regulations, including the Environmental Protection Act 1990 and Waste Regulations 2011.

We aim to perform the Services on the agreed date and time ("Booked Date" and "Booked Time"), but these are estimates and may be affected by circumstances outside our control.
6. Your Responsibilities

Provide accurate and complete information when booking, including details of the type and volume of waste and access arrangements.

Do not include hazardous or restricted items without prior written consent (e.g., asbestos, chemicals, oils, medical waste, gas cylinders).

Ensure safe access to the property. We may refuse or suspend Services if the area is unsafe or blocked.

Treat our team and any contractors with respect We reserve the right to stop work if we are
subject to unsafe or abusive conditions.
7. Pricing

All prices are based on the information provided when booking.

Fees may vary depending on the type, volume, and location of waste, as well as labour required.

We may adjust fees if the actual conditions differ from the booking details.

All prices include VAT at the current rate.
8. Payment

Payment must be made in full at the time of booking, unless an alternative arrangement has been agreed in writing

Invoices are payable on presentation. Overdue payments may accrue interest at 2% per month above the Bank of England base rate.
9. Cancellation and Rescheduling
By Customers -

Consumers may cancel a booking more than 24 hours before the scheduled time without charge.

Cancellations within 24 hours may incur an administration fee of £35 + VAT
-
If our team attends but cannot complete the Service due to blocked access or other reasons outside our control, a wasted journey fee of £35 + VAT applies.
By Businesses -

Business customers cancelling within 24 hours may be charged £40 + VAT, plus any Supplier costs.

No refund is given once the Service has commenced.
By EZ Waste Removals -

We may postpone or cancel bookings due to unsafe conditions, Supplier issues, or other unforeseen events. Any costs reasonably incurred will be communicated to the Customer.
IO. Refunds

Payments made in advance will be refunded only if cancellation occurs in accordance with these Terms, less any applicable fees.
11. Liability

We are not liable for indirect or consequential losses, including loss of profit, business, or goodwill.

Our total liability for any claim (whether contract, tort, or otherwise) is limited to the fees paid for the Services.

Consumers may have limited additional liability coverage if we were made aware of specific circumstances affecting the Service in writing.

Property damage claims must be reported within 48 hours, with supporting photos and a description.
Exceptions: Nothing in these Terms limits liability for death, personal injury caused by our negligence, or fraud.
12. Third Party Rights

No third party has rights under this contract.

You may not assign your rights or obligations without our consent We may transfer our rights and obligations as needed.
13. Governing Law

These Terms are governed by English law.

Disputes will be subject to the exclusive jurisdiction of the English Courts.
